TERMS OF SERVICE AGREEMENT

This policy details the terms of service (“Terms”) covering use and access of products, services, and websites (“Services”) that Dr. Pipette (“we”, “us”, “our”) maintains with our customers, partners, and visitors (“you”, “your”, “yours”). Dr. Pipette is committed to transparency which is why these terms are clearly stated herein. Through interacting with Dr. Pipette, you automatically agree to the entirety of the terms and conditions outlined in this document. 

OVERVIEW OF TERMS

  • These Terms of Service and Privacy Policy constitute the entirety of our agreement between you and Dr. Pipette.

  • We reserve the exclusive right to modify the terms in this document with or without prior notice. Any changes will be published directly onto this document, as required by law.

  • Through continuing to use or access our products and services, you automatically agree to the full extent of these Terms once revisions are in effect. It is your sole responsibility to review these Terms. 

ELIGIBILITY

  • In order to place an order, access our services, or work with our team, you must be aged 18 or older. 

  • You are required and responsible to review the entire Privacy Policy and Terms of Service prior to working with us. By working with us, all users knowingly acknowledge and agree to the entirety of both policies.

USER GUIDELINES

All users agree to adhere to the following guidelines when using our website, interacting with our representatives, or conducting business with Dr. Pipette:

  1. The use of hate speech or abusive language is not tolerated.

  2. Any harassment, explicit content, threats, or bullying is not tolerated.

  3. No malicious code, malware, phishing, scams, or illegal business practices are tolerated.

  4. No fraudulent transactions, chargeback, or other illegal action is permitted.

Failure to adhere to these guidelines will result in punitive action, including but not limited to account suspension, account termination, or legal action. Dr. Pipette reserves the exclusive right to terminate a relationship with you for any reason, even reasons not explicitly stated in our guidelines. The safety of our customers and team is of paramount concern, and these guidelines are strictly enforced.

The use of our platforms is done at your own risk. We are not responsible for the actions taken by customers, visitors, or other persons not affiliated with Dr. Pipette. 

PROPERTY RIGHTS

  • Dr. Pipette retains exclusive ownership of all intellectual property, tangible and intangible assets that are associated with our operations, including those on our website, online store, social media platforms, or other company channels.

  • Our exclusive rights to all proprietary materials extend to, but are not limited to artwork apparel designs, merchandise designs, written content, graphics, visual media, animations, video content, or other multimedia format.

  • Unauthorized reproduction, resale, alteration, copying, distribution, or modification of any proprietary materials is strictly prohibited, without explicit written consent from Dr. Pipette.

  • The use of our designs, logo, trademarks, or brand identity is strictly prohibited, without explicit written consent from Dr. Pipette.

  • Any violations of property rights will be reported and pursued to the fullest extent permitted by law.

STATEMENT ON THIRD PARTIES

Dr. Pipette may work with third parties at our discretion. We may work with third parties to assist with our operations, fulfillment, design, technology, or other business purposes. We do not necessarily endorse or promote their beliefs, values, and decisions. We are not held liable for any actions taken by any third party partner. 

Information on how we can collect and use data with regards to third parties can be found in the Privacy Policy.

PURCHASES

  1. All purchases must be made on our online website, contact.drpipette@gmail.com

  2. All purchases are billed and paid in full before fulfillment and delivery.

  3. Alternative payment methods are not accepted. Specific payment alternatives or accommodations are made at our sole discretion.

REFUNDS

We do not offer refunds or exchanges for any of our products or services. In rare cases, we may handle disputes on an individual basis as outlined in our refund policy.

TERMINATION

Dr. Pipette reserves the exclusive right to pause, delay, or terminate our relationship with you at any time. These rights include, but are not limited to, payment cancellations, account suspensions, or account terminations. 

INDEMNIFICATION

You agree to protect, defend, indemnify, and hold Dr. Pipette harmless from any and all claims, liabilities, judgments, penalties, losses, costs, damages, and expenses (including attorneys’ fees and related litigation or arbitration costs) incurred by us, including but not limited to claims arising from: 

  1. Your actual or alleged breach of these Terms or our Privacy Policy. 

  2. Your wrongful or improper use of the Services. 

  3. Your violation of any third-party rights, including privacy, publicity, or intellectual property rights. 

  4. Your violation of any applicable laws, rules, or regulations in the state of Nebraska, the United States, or any other location. 

  5. Unauthorized access or use of the Services by others using your credentials (e.g., name, password, or security code). 

  6. Copyright infringement claims arising from our scanning of Legal Documents or mail on your behalf. 

  7. Failures by third parties, such as the United States Postal Service or other courier services, to provide accurate and timely delivery.

  8. Loss, damage, or destruction of your Legal Documents for any reason. 

  9. Our involvement in legal actions as your registered agent. 

  10. Claims or actions resulting from your failure to keep your information updated on our platforms.

AS PERMITTED BY LAW, Dr. Pipette AND ITS PARTNERS, STAFF, CLIENTS, INVESTORS, AND OTHER PERSONNEL ARE NOT RESPONSIBLE FOR (I) YOUR ACCOUNT ACTIVITY AND PURCHASE DECISIONS (II) YOUR FAILURE TO ADHERE TO OUR PRIVACY POLICY, TERMS OF SERVICE, AND OTHER AGREEMENTS (III) ANY MALICIOUS, ILLEGAL, OR FRAUDULENT ACTIVITY ON YOUR ACCOUNT. 

Dr. Pipette IS NOT LIABLE FOR ANY DIRECT, INDIRECT, ACCIDENTAL, CONSEQUENTIAL, COMPENSATORY, PUNITIVE, LOSS, OR OTHER DAMAGES OF ANY KIND. WE ARE NOT LIABLE FOR ANY LOSSES OR DAMAGES. ALL PURCHASES ARE KNOWINGLY AND WILLINGLY MADE AT YOUR OWN RISK.

COPYRIGHT

  1. We hold the exclusive copyright to all proprietary content including, but not limited to photos, illustrations, drawings, graphics, artwork, written content, animations, video, or other multimedia found on our website, merchandise, or other business channels.

  2. Unauthorized reproduction, resale, alteration, copying, distribution, or modification of any proprietary content is strictly prohibited, without explicit written consent from Dr. Pipette.

  3. You agree not to use our proprietary content for any commercial purposes, without explicit written consent from Dr. Pipette.

  4. You agree not to post, upload, or share any proprietary content without crediting Dr. Pipette, and without explicit written consent from Dr. Pipette.

  5. Any instances of copyright infringement will be reported and pursued to the fullest extent permitted by law.

DISCLAIMERS

These terms may be modified at any time exclusively by Dr. Pipette. These terms may be modified with or without notice. Any updates will be appended to this document. It is your sole responsibility to review these changes. 

This policy details the exclusive relationship between our customers, partners, and visitors (“you”, “your”, “yours”) and Dr. Pipette (“us”, “we”, “our”). This policy is not valid for any other relationship or circumstance.

All of our products and services are at your own risk. We are not liable for any losses or damages. Through continued use of our services, you agree to these terms defined in this Terms of Service and our Privacy Policy.
